"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer alien smuggling allegations, he was held in federal detention.
In her decision, the court noted that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
